It remains the main bone of contention for the Member States of the European Union, including Portugal: the so-called “workability indicators”, that is, the criteria that must be verified for a worker on digital platforms (such as Uber, Bolt or Glovo ) is considered a dependent worker and therefore a link to the platforms (or intermediaries) is recognized.

The discord is especially visible at a time when the Czech EU Presidency is trying to reach an agreement with the Member States to approve a joint guideline proposing amendments to the European Commission’s proposal for a directive, presented in December last year, which aims to end false freelance work on the platforms. This Thursday, the Council of Ministers of Social Affairs of the Union will vote on the proposal, but it is not certain that it will pass the scrutiny.

The proposal from Brussels, one year old, spoke of two indications of workability, out of a total of five, that had to be verified for a court to force a worker to be linked. Here, the PS proposal maintains the two indications that must be met, but adds one more possible criterion to the list, for a total of six.
