Competition imposes a fine of 1.2 million euros on Farmodietica for imposing sales prices

The Competition Authority (AdC) imposed a fine of 1,258 million euros on Farmodiética — Cosmética, Dietética e Produtos Farmacêuticos for setting and imposing retail prices (RRP) on distributors.

The regulator, in a statement released this Monday, explains that the practice of fixing prices for (re)sale to the public, practiced by the supplier of food supplements and healthy food products, represented “a high degree of harmfulness” for the competition.

The AdC investigation concluded that, between 2015 and 2022, Pharmamodiet imposed on distributorsregularly and widely the prices at which your products should be sold to end consumersimposing resale prices on distributors by sending lists of retail prices (RRP) and defining the maximum limit of applicable discounts on the RRP of the products.

For this, Farmodiética implemented a control and monitoring system for compliance with the resale prices set by it (or the authorized discount limit)”, concluded the regulatory body.

At the same time, he also says, the company will have created a system of incentives, “threats or reduction of trading conditions” of its distributors, as well as cutting off the supply or limiting the replacement of stocks in case of non-compliance.

The process opened by the AdC was concluded early thanks to the collaboration of the company, which agreed to the transaction procedure, taking responsibility for the infraction in question, abdicating the legal dispute and putting an end to the anti-competitive practice.

Farmodiética is a company that provides food supplements and healthy eating products, present in various distribution channels throughout the national territory.
