Rio Justice rejects injunction defending ex-councilman Jairinho

Measure requested by ex-council member’s defense , Doctor. The postponement of Jairinho’s questioning hearing, scheduled for tomorrow (13), was rejected by Judge Joaquim Domingos de Almeida Neto of the 7th Criminal Division of the Court of Justice. (TJRJ).

The former councilor is charged with the death of Henry Borel on March 8, 2021, as is the boy’s mother, teacher Monique Medeiros da Costa e Silva. The boy was tortured in the apartment where the couple and Henry lived in Barra da Tijuca, Rio’s Western District.

In the request, Jairinho’s lawyers stated that the defense was restricted as a result of the Capital 2nd High Criminal Court’s decision to reject the request for hearing of three doctors who helped the child Henry Borel at Barra D’Or Hospital; a radiologist from the same hospital unit; technicians who performed the autopsy examination on the victim; and forensic scientist Gabriela Graça Suares Pinto. In the defense’s understanding, a new date should be set for Jairinho’s statement only after hearing these people.

Inquiry made

In Friday’s verdict (10), the judge continued the questioning of the accused, scheduled for 9 a.m. Monday (13). The judge stated that three doctors and radiologists testified and other witnesses were not called at the appropriate time.

The magistrate added that the right to adequate defense does not guarantee the adoption of delaying actions in the process.

“Ensuring that the defense is complete does not lead to the absurdity of continuing the process, of digging into nothingness every time the process approaches resolution, of asking for new evidence to be produced. In this regard, I reject the interim injunction,” he said.
