Minister of Justice defends improvement of company recovery processes

The Minister of Justice stressed this Saturday that improving the conditions of the recovery processes of companies is a challenge, especially “in periods of insolvency and doubt” such as the one that the country is going through.

“Improving the conditions for recovery processes [de empresas]especially in periods of insolvency and doubt, like the one we are going through, it is a challengebut a challenge that we have to meet”, said this Saturday the Minister of Justice, Catarina Sarmento e Castro, who was speaking at the opening of the National Meeting of the Portuguese Association of Judicial Administrators (APAJ), which is being held at the Casa do Juiz, in Coimbra.

The minister stressed that this improvement also involves “the digitization of processes”, considering that, in this area, the The Recovery and Resilience Plan (PRR) appears as “an opportunity” that must be seized.

For Catarina Sarmento e Castro, digitalization will also contribute “to reduce the costs of the context” and so that justice “can, in fact, reach citizens and companies”, as well as increase the speed “that is required” in these processes.

According to the official, it is necessary “to speed up these recovery and liquidation processes”, without ever “losing everyone’s interest”.

The minister also stressed that the Government also intends to strengthen transparency and scrutiny in the appointment of judicial administrators.

“We want to reinforce scrutiny, a scrutiny that imposes the functioning of justice and democracy”he defended, considering that the increase in transparency will also increase “everyone’s confidence in justice”, particularly those who benefit from the judicial administration of the insolvency, liquidation or recovery of companies.

The president of the Association of Judges of Portugal (ASJP), Manuel Soares, also spoke at the inaugural session, leaving several notes on issues that, in his opinion, need to be resolved in this area.

According to Manuel Soares, it is necessary to find a way to facilitate the access of judicial administrators to the data held by the Tax Authority and he pointed out the problems created with the new model for the calculation of the remuneration of judicial administrators.

The ASJP president also warned about the need for transparency in the assignment of cases by judicial administrators.

“The procedures followed by the courts are not always uniform. There are courts where the distribution is not fair or balanced, ”she said, considering that“ you see who has more and better distributed processes ”.

The model “is not completely transparent”, which could generate mistrust, he warned.
