Delaware Chancellor Kathleen McCormick ruled in favor of Twitter on Tuesday, accepting the company’s request for an expedited trial in the $44 billion legal battle between the social network and Elon Musk. Testing is scheduled for October, although Musk wants to delay it until 2023.
CNBC reports that Delaware Court Chancellor Catalyn McCormick recently approved Twitter’s move to speed up the lawsuit against billionaire Elon Musk, who attempted to pull out of a $44 billion social media deal. The five-day trial will take place in October.
Twitter’s attorney, William Savitt, of Wachtell, Lipton, Rosen & Katz, argued that Twitter’s request for expedited proceedings was consistent with the timing of lawsuits of a similar nature in the past. Savitt said a speedy trial is important because Twitter must end the ongoing damage the company has suffered due to uncertainty over the disclosure of the deal and Musk’s alleged embarrassment.
Savitt argued that Musk’s attempts to delay the trial could be a ruse to “steal time”, leaving little time for an appeal before he borrowed money to finance the deal.
Musk’s lawyer, Andrew Rossman of Quinn Emanuel, argued that the fast track test was too aggressive for his team to verify the data provided by Twitter, which Musk wanted to review to control the number of spam accounts on the platform.
Rossman said Twitter wanted to “continue collecting” the number of bots on the platform and did not provide the information Musk requested. However, Savitt said that in this case it is unnecessary to define the bot account’s share of the platform because “nothing in the integration agreement addresses this issue.”
