A loophole in the Law on the Full Guarantee of Sexual Freedom led to the reduction of the sentences of 15 people convicted of sexual crimes since last October, including that of a man who raped his 14-year-old stepdaughter.
The Spanish government is going to change the law on the Comprehensive Guarantee of Sexual Freedom —known as “Only yes is yes”—, a decision that it announces some eight months after the diploma was approved in Parliament. Although it is not known for sure how this change will be made, Pedro Sánchez hopes to “stop the bleeding” that the image of the Government has suffered since the entry into force of the law, according to El País.
The controversies began about three months ago, when the law began to be applied and a legal loophole led to the automatic reduction of the sentences of some convicts. This happened because the range of sentences was expanded, with lower minimum sentences in some cases, which led the legal representatives of some convicts to seek to adapt their sentences to the new law.
About 15 criminals obtained automatic sentence reduction, according to the BBC. Among them is a man who sexually abused his 14-year-old stepdaughter. Even three convicts were released.
In November, the controversy in Spain worsened when it was realized that the change in the legal regime did not include a transitory provision, a set of rules that established the passage from one code to another and that could limit the cases subject to review of the sentence. . .
