Brussels proposes ending the procedure against Poland after six years

The European Commission declared that thanks to the measures implemented by the government of Polish Prime Minister Donald Tusk “there is no longer a clear risk of a serious violation.”

The European Commission proposed this Monday the end of the procedure opened against Poland for disrespecting the values of the European Union (EU), including the rule of law, by recognizing the country’s “hard work and effort” after six years.

“The present day [segunda-feira] marks a new chapter for Poland. After more than six years, we believe that the procedure provided for in article 7 [do Tratado da UE, acionado perante ameaças sistémicas nos países da UE ao nível do Estado de direito] It can be closed,” announced the president of the community executive, Ursula von der Leyen, in a social media post.

Underlining that this “is the result of Poland’s hard work and efforts to carry out certain reforms”, the leader of the European Commission congratulates Prime Minister Donald Tusk and his government, which has been in office since December 2023 and achieved more than eight years of ultraconservative power, for “this important advance.”

In a statement, Brussels then states that, after completing its analysis, it intends to close the case on the rule of law in Poland in the context of the procedure provided for in Article 7(1) of the EU Treaty, arguing that “there is no longer a clear risk of serious non-compliance“.

“Poland launched a series of legislative and non-legislative measures to address concerns regarding the independence of the judiciary, recognized the primacy of EU law and committed to implement all rulings of the Court of Justice of the European Union and the Court of the European Union of Human Rights. Rights related to the rule of law, including judicial independence,” lists the institution.

Poland will join the European Public Prosecutor’s Office

Brussels proposes this evaluation to the Council (at Member State level) and Parliament to close the case dating back to the end of 2017.
