Judge Margarida Alves granted the promotion of the Public Ministry and changed the coercive measure of José Sócrates. Thus, the former prime minister is obliged to go every 15 days to the GNR post in Ericeira to present himself, so that the authorities know where he is.

The Lisbon District Judicial Court found that Socrates violated the rules of the Term of Identity and Residence.

“Considering the proven facts, we believe, at this time, it is appropriate and proportionate to set the periodicity of the aforementioned fortnightly presentations,” reads the order of Judge Margarida Alves.

It is recalled that, as the Observer reported this Thursday, Judge Margarida Alves had already concluded that there was a “clear violation” of José Sócrates’ obligations as a defendant subject to a term of identity and residence in a certificate from Operação Marquês. The magistrate’s expression appears in the order that determined the interrogation that took place this Thursday morning in the Lisbon District Judicial Court to re-evaluate the former prime minister’s donation measures.

In the same order, dated June 20, the magistrate affirms having received “information” from the “Interpol National Office” that “the accused José Sócrates Carvalho Pinto de Sousa had gone abroad, more specifically to Brazil, for periods longer than five days without informing the court”.

That is, a “clear violation” of the “obligation” provided for in the Code of Criminal Procedure, which determines that no defendant may be absent from his home for more than five days.
