The Polish president says that the agreements with Brussels on judicial reform have been broken

The Polish president, Andrzej Duda, considered this Monday that “the agreements with the European Commission were broken” and accused the judges of “just wanting power”, reacting to the action of the European judicial associations against Poland.

The Polish president thus reacted to the news that four European associations of judges appealed the decision of the executive of the European Union (EU) to approve the judicial reform presented by Poland in June, something fundamental for the Polish Recovery and Resilience Plan (PRR) can count on European funds.

Duda says that “it seems that the word given does not interest the European Commission, its representatives or some politicians from the European institutions. This is, unfortunately, a brutal policy.”

As you can see, the judicial circles only want power”, said the Polish president, warning that this situation, in which the judicial bodies ask the European Commission not to approve the Polish amendments, “should set off alarm bells in other European countries” .

The approval of the Polish PRR, which provides for the delivery of up to 35.4 billion euros to Warsaw in European funds, involved changes in the scope of the Polish judiciary required by Brussels to guarantee the independence of judges in Poland and, among other measures, triggered the elimination of the controversial Disciplinary Chamber (a disciplinary mechanism for Supreme Court judges).

Duda prepared a legal reform that replaced that body with another with equivalent powers, which, according to the jurists, is an insufficient reform, and in addition, the magistrates suspended by the Disciplinary Chamber have not yet been replaced in their positionswhich was one of Europe’s conditions for approving the Polish reform.

I myself prepared the law on changes in the Supreme Court of Poland, in line with the expectations of the Court of Justice of the European Union. But, as you can see, despite all the agreements, despite my talks, these agreements were broken,” the Polish head of state also stressed.
