Venezuelan court rejects appeal against sentence that validated the re-election of the President

The Supreme Court of Justice of Venezuela rejected António Ecarri’s appeal against the Constitutional Chamber and confirms the validation of the official results of the last presidential elections.

The Supreme Court of Justice (STJ) of Venezuela rejected this Tuesday an appeal for review, presented by former presidential candidate António Ecarri, against the ruling of the Constitutional Chamber of that body that validated the official results of the last presidential elections.

This is the second appeal not admitted by the STJ against the decision of the Electoral Chamber, which on August 22 validated the results released by the National Electoral Council (CNE) that declared Nicolás Maduro as re-elected president, but that the opposition and a The vast majority part of the competition of the international community, naming Edmundo González Urrutia as the winner, based on the minutes available.

On September 10, presidential candidate António Ecarri said at a press conference in Caracas that “I would not sit idly by in the face of such great popular discontent and with legitimacy at stake”after questioning the technical expertise of the STJ Electoral Chamber, which validated Maduro’s victory, despite the fact that the CNE still has not published the electoral records and detailed results of the process.

Ecarri intended to annul the acts of the Electoral Chamber, considering them “contrary to the Constitution and the Laws” of the country.

Last Saturday, the STJ also rejected a review request requested by former presidential candidate Enrique Márquez against the ruling of the Electoral Chamber that ratified the CNE results that gave victory to Nicolás Maduro.

The STJ understood that the procedure that validated the results “was carried out impeccably, with the necessary guarantees” and that “demonstrates the unobjectionable integrity” of what was announced by the CNE.

According to the STJ, the Electoral Chamber has “the authority” to investigate and verify the results of the electoral processes and the objective was to “clearly and unequivocally certify the will of the voter” in the presidential elections on July 28.

Enrique Márquez stated that, despite the announcement, the Electoral Chamber has not yet published the ruling, while the CNE has not published the results.

Venezuela, a country that has a significant community of Portuguese and Portuguese descendants, held presidential elections on July 28, after which the National Electoral Council (CNE) attributed the victory to Maduro with just over 51% of the votes, while The opposition claims that its candidate, former diplomat Edmundo González Urrutia, obtained almost 70% of the votes.

The Venezuelan opposition and several countries in the international community denounced electoral fraud and demanded that the voting records be presented for independent verification, which the CNE says is unviable due to a “cyber attack” of which it was supposedly targeted.

The electoral results were disputed in the streets, with demonstrations repressed by the security forces, with a balance of more than two thousand arrests and more than two dozen deaths.

According to the NGO Fórum Penal (FP), Venezuela has 1,916 citizens imprisoned for political reasons, of which 240 are women and 70 adolescents between 14 and 17 years old.
