Judge Ivo Rosa withdrew the accusation against three of the seven companies accused in the GES/BES mega case after realizing that, despite being accused since at least 2016, they had never had a lawyer to represent them throughout the process. . According to the order to which the Observer had access, the Public Ministry assumed that the lawyers who would accompany the representatives of the companies would be the same as those of the companies —however, there is no power that indicates this in the case.
Thus, according to the decision of Ivo Rosa signed this Thursday, the accusation of crimes such as qualified fraud against Espírito Santos International (ESI), Espírito Santo Turismo and Espírito Santo Resources falls even before the preliminary decision (which by imposition of the Superior Council of the Judicial Power must be issued before February 2022). Judge Ivo Rosa also warns that the same happens with a fourth company, Espírito Santo Irmãos, but since no one in the process invoked nullity, for now it does not draw legal consequences. The process to which Ivo Rosa had added five defendants, thus leaving 30 defendants (seven of which companies) now has 27 (four of them companies).
