Italy blocks ChatGPT for alleged privacy violations

The Italian regulator says that ChatGPT cannot verify the age of users and denotes “absence of legal basis to justify the collection and mass storage of personal data.”

The decision has “immediate effect”: Italy blocked ChatGPT, a service similar to a chatbot which was created by OpenAI, citing alleged privacy violations. The block, announced this Friday, is temporary and will end when the Italian data protection regulator (Guarantor for the protection of personal data) consider that the General Data Protection Regulation is being respected.

In a statement, the regular says that he notes “the lack of information for users and all interested parties whose data is collected by OpenAIbut above all the absence of a legal basis that justifies the collection and massive storage of personal data, in order to ‘train’ the algorithms that support the operation of the platform”.

ChatGPT will have suffered a data breach, which caused conversations about the use of payment information to be exposed, writes the Italian authority. In addition, the service is accused of not verifying the age of users – it should be exclusively for people over 13 years of age – which “exposes minors to absolutely inappropriate responses given their degree of development and self-awareness.”

“TO OpenAI does not have an office in the European Union, but the representative [que designou] in the European Economic Area you have 20 days to communicate how you plan to make ChatGPT compliant with EU privacy regulations.” Otherwise, you could be fined up to 20 million euros or up to 4% of your global annual turnover.

OpenAI has not yet reacted to the blockade, nor has it ruled on Italy’s decision at the request of Reuters and the Politico newspaper. The news agency estimates that ChatGPT reached 100 million monthly active users in January, just two months after its launch.

Italy’s decision comes at a time when, in the US, Elon Musk and dozens of AI experts called for a six-month hiatus on AI development to “jointly develop and implement a series of protocols security, for the design and development of advanced Artificial Intelligence”.
