The General Court of the European Union upheld the European Commission’s decision on the fine to be imposed on Google for the Android operating system. “The General Court widely confirms the Commission’s decision that Google imposed unfair restrictions on Android mobile device manufacturers and network operators to consolidate its dominant position in its search engine.
Despite being a decision that goes against the wishes of the internet giant, not everything is negative for the company, since the fine suffered a slight reduction, from 4,340 million to 4,125 million. “To reflect the seriousness and duration of the infringement, the General Court considers it appropriate, however, to impose a fine of 4,125 million on Google, with considerations that differ in several aspects from those of the Commission”, consider the judges. of this court.
The General Court considered that revenue sharing tactics with manufacturers using Android in their smartphones do not necessarily constitute an abuse of dominant position, thus reducing the amount of the fine.
