GES. Megaprocesses deserve reflection by the entire legal community, says Minister of Justice

The Minister of Justice considered on Wednesday that the “megaprocesses deserve the reflection of the entire legal community”highlighting that it is important that justice be “as close as possible to the facts”, in reference to the BES/GES case.

“There was a great process. “10 years have passed since its inception and the important thing is that justice is as close as possible to the facts,” he told journalists, within the framework of the 13th National Meeting of the Portuguese Society of Lawyers (ASAP), at the Cultural Center from Belem. in Lisbon.

Rita Alarcão Júdice responded like this after being asked about how digital processing, which will come into force as of December 3, could be fundamental in the reform of megaprocesses.

“Mega processes deserve reflection from the entire legal community and I believe that this process that has now begun after 10 years will help us all to make this reflection,” he highlighted.

“It will allow greater speed, greater ease in processing tests, greater ease of communication,” he highlighted.

At the opening of the ASAP meeting, Rita Alarcão Júdice said that starting December 3, lawyers “will start presenting all written documents electronically” and that, starting in April next year, consultation of the processes will be will do electronically.

Electronic communications will also apply to the sending of news by the GNR, the PSP and the Judicial Police.

“We believe that this measure […] It will make a big difference in the smoothness of the criminal process. “It is a good measure for the courts, good for lawyers and, above all, good for those seeking justice,” he observed.

The former president of the BES, Ricardo Salgado, is the main defendant in the BES/GES case and is responsible before the courts for 62 crimes, allegedly committed between 2009 and 2014.

Among the crimes charged are one of criminal association, 12 of active corruption in the private sector, 29 of qualified fraud, five of infidelity, one of market manipulation, seven of money laundering and seven of document falsification.

According to the Public Ministry, the collapse of the GES will have caused losses of more than 11.8 billion euros.
