Police said the group was arrested on trespassing charges because “group members were told they would be escorted inside the buildings by personnel before entering the Congressional buildings, and it was not done.”

Now they are free from all kinds of mistakes.

This is stated in a statement by the U.S. Attorney’s Office. Evening Show staff were invited to the congressional staff building for interviews and were never formally asked to leave the area, even though the Capitol police told them they should have an escort. The description was:

After a thorough review of all the evidence and the relevant legal authority, the U.S. District Attorney’s Office decided that it could not file an illegal entry charge against the nine people arrested at the Longworth Office Building on June 16, 2022.

The office must prove beyond a reasonable doubt that these invited guests are guilty of trespassing because their attendants choose to leave them unattended. We do not believe that the Bureau can secure and maintain jurisdiction over these allegations.

He added that by the end of this month, these people will no longer need to appear in court.

Colbert defended his team, saying they made “a few last-minute first-degree puppet shows and make-up pranks” when they were detained. He added that all participants were calm and professional.

The veteran host did not apologize for the incident.
