During a visit to Cyprus, Marcelo Rebelo de Sousa was asked about the case of Minister Pedro Nuno Santos, who has a company with his father, Tecmacal, which benefited from a public contract by direct agreement. The news was announced by the Observer this Friday, referring to the fact that the conclusion of the contract constitutes an incompatibility, in accordance with the law that establishes the regime for the exercise of functions by the holders of political positions and high public positions.
Questioned by the press about the company of the Minister of Infrastructure, Marcelo Rebelo de Sousa explained that he “never” talks about “concrete cases”, but about abstract cases. “And, the cases in the abstract have already said that if the law defines certain rules and incompatibilities – and there are situations that are covered by those rules – then it is to stop the incompatibility.”
“There are, however, other situations – I don’t know if this is not the case – in which there are no incompatibilities, because the law defines certain percentages of capital in companies that enter into public contracts. If this percentage or a certain type of contract is not reached, then the law does not apply. You have to see it in the abstract, I can say it concretely, yes, if not, so that there are no generalizations”, declared Marcelo Rebelo de Sousa.
