Eurico Brilhante Dias says that the “PS will allow all the hearings it deems pertinent” to explain the case of the alleged incompatibility of Minister Pedro Nuno Santos, revealed exclusively by the Observer.
Asked on SIC Notícias, during the Expresso da Meia Noite program, about whether the PS will allow the minister to be heard in Parliament, if requested by a party with a parliamentary seat, the leader of the PS caucus was clear: “I have nothing to object, but I don’t think there is any case.”
Pedro Nuno Santos and his father’s company signed a contract with the State. Law foresees dismissal, minister defends himself with old opinion of the PGR
Reinforcing the question, Brilhante Dias stated that “the PS will allow all the hearings it deems pertinent.”
Eurico Brilhante Dias says that “there is no incompatibility involved”, since Pedro Nuno Santos “scrupulously complied with both the current law and the previous one”.
The socialist said that the company in question is not under the tutelage of the minister, and, “in that circumstance, [a lei] does not apply” to Pedro Nuno Santos, who has a minimal stake in the business. Thus, unless new facts arise, Eurico Brilhante Dias affirms that “the reality is that there is no incompatibility”.
It is recalled that, as reported by the Observer, the law that establishes the regime for the exercise of functions by the holders of political positions and high public positions defines that there are three situations of incompatibility in cases similar to those of Pedro Nuno Santos and his dad:
- when the holder of a political office directly owns more than 10% of the capital of a company that has contracts with the State, which is not the case
- when the relative of the political official is the owner of a company that contracts the supply of goods or the provision of services – which was overcome with an extraordinary opinion of the Consultative Board of the Attorney General’s Office in 2019.
- When a political official and a family member jointly own more than 10%, an issue that is not addressed by the opinion of the PGR and that is the center of the revealed case.
