On Monday, FNC’s Jesse Watters, a law school professor at George Washington University, followed Primetime news that the FBI had raided former President Donald Trump’s Mar-a-Lago home in Palm Beach, Florida, for unknown reasons. and constitutional lawyer Jonathan Turley posed the question. Why hadn’t Attorney General Merrick Garland contacted special counsel before giving the go-ahead for the raid?
According to Turley, potential politicization will require an impartial investigation, which can be conducted with the involvement of a special prosecutor.
“Well, it’s an exciting moment to launch such an attack against a former president and possibly a future opponent of the current president,” he said. “My first reaction after the shock was that it wasn’t clear how this raid happened, but Merrick Garland has decided not to appoint a special attorney. If there was evidence to support the warrant, and a federal judge apparently found it, why didn’t Merrick Garland call a private attorney? You know, people like Archibald Cox and others became famous for appointing a special counsel to investigate the Nixon case. Why? Why? This is because we want to assure the American people that the investigation that Nixon himself cannot influence will not be political.”
“You now have a past competitor of the current president and a possible future competitor,” Turley continued. “I can’t imagine how Attorney General Garland looked at this situation and didn’t see the absolute need for a private attorney. Instead, they raided the former president’s house. And what you see will cause anger. We don’t know what these accusations are. It must be about January 6th. We’ve seen the grand jury verdicts. I have expressed my doubts about the possibility of impeaching the president based on the evidence we have already seen in this committee.”
“But for me there is a threshold question as to who should order such raids,” he added. “Merrick Garland refused to appoint Hunter Biden as special counsel. It seems he still hasn’t appointed a special attorney for this case. I just don’t understand why.”
