TAP crew members admit not complying with the obligation to go to a new flight after cancellation

The TAP team approved a motion that determines that they are not obliged to respect TAP’s decision so that, after a cancellation, they can be called, “immediately”, for another flight.

The National Union of Civil Aviation Flight Personnel (SNPVAC) held an emergency general assembly this Friday, with the first point of the vote, above all, being a TAP decision, which determines that, after a discharge, the crew member can be called to another flight, which may happen sooner than expected.

The National Civil Aviation Authority (ANAC) presented a determination, in which it can be read that “either the application of a shared flight service, or the application of an assistance service has to be the object of planning and, naturally, respect that same planning”.

Given this, the TAP crew decided to “express their agreement” with the position of the SNPVAC, which requires compliance with the interpretation of the ANAC, according to the document to which Lusa had access.

On the other hand, “they will express their individual and collective will to comply with the legislative interpretation of the ANAC, thus not entering into disobedience to the guidelines issued by the regulatory authority of the aviation sector in Portugal.”

The pilots will also entrust to the union leadership the request to convene a new emergency general assembly, “in case there are complaints of non-compliance or opening of disciplinary proceedings by TAP regarding the legislative interpretation of ANAC.” This meeting will serve to adopt “new protection measures” for cabin crew.

The motion, approved with 172 votes in favor, five against and two abstentions, indicates that the airline had already been informed of this interpretation of the ANAC by the union and that to date nothing had changed. As for the ANAC decision, TAP argues that it is not binding.

For the union structure and the crew, this interpretation annuls the “mere circumstantial interpretations” of the company. “[…] All crew members respect the National Civil Aviation Authority and do not intend to respond to it for disobedience,” they stressed.
