Supreme Court of Mexico maintains controversial judicial reform

The High Court found that the “unconstitutionality appeals” were “unfounded”, keeping in motion the controversial reform of the country’s judicial system, implemented by the party in power.

The Supreme Court of Mexico on Tuesday rejected an appeal to annul a controversial reform of the country’s judicial system, implemented by the ruling party, thus avoiding a political crisis.

The appeal was presented by two opposition parties, which are against the reform, which implements the election of all judges and magistrates in the country by universal suffrage starting in June 2025, an unprecedented measure worldwide.

A qualified majority of eight of the eleven judges of the Supreme Court threatened to vote in favor of the annulment.

However, a last-minute change of mind by one of the judges changed the balance of forces.

“These unconstitutionality appeals are dismissed as unfounded.“the court wrote in the decision, after more than five hours of public deliberation.

Promulgated in mid-September by former president Andrés Manuel López Obrador, after a complex adoption process by parliament and the majority of states, the reform is being ardently defended by the new president, Claudia Sheinbaum, who took office on 1 of October.

With a large parliamentary majority, the left justifies the reform as a means to combat corruption, nepotism and the privileges of unelected judges.

“I am glad that reason, decency and legality have prevailed,” the president of the Senate (upper house of parliament), Gerardo Fernández Noroña, told the press after the court’s decision.
